Terms and conditions
These Terms govern use of the platform, accounts, artificial-intelligence features, credits and Premium access.
1. Provider and acceptance
The service is provided by Carlos Hinojosa Pinto. You can contact us at jacklyt.code@gmail.com.
By creating an account or using features that require an account, you accept these Terms to the extent permitted by applicable law.
2. Service tools
The platform provides four main types of language-learning tools: browsing and studying vocabulary, generating vocabulary with artificial intelligence, reading learning texts and chatting with AI characters.
Each tool may include free content and Premium content.
3. Account
- You must provide accurate information and keep your access methods secure.
- You are responsible for use of your account except where unauthorised access is not attributable to you.
- Do not share credentials in a way that compromises service security.
- We may apply reasonable verification and security measures.
4. Credits and payments
Credits are purchased through one-time payments. Each purchase adds the number of credits shown before payment is confirmed to the account.
There are no monthly subscriptions, recurring fees or automatic renewals associated with credit purchases.
Credits are units of use within the platform. They are not electronic money, do not accrue interest and cannot be transferred or redeemed for cash unless applicable law requires otherwise.
Certain features, especially some artificial-intelligence features, may consume credits. The applicable cost should be shown in the platform where relevant.
Paddle processes purchases and acts as Merchant of Record for transactions completed through its checkout.
Prices are shown in USD. Paddle acts as Merchant of Record for purchases made through its checkout and calculates, collects and handles applicable sales taxes. Applicable taxes and the total price will be shown during checkout where relevant.
5. Premium access
The first successfully completed credit purchase unlocks Premium status for that account.
Premium status gives access to Premium content available in vocabulary, AI vocabulary generation, reading texts and character-chat tools.
Premium status and the credit balance are independent. Using all remaining credits does not by itself remove Premium access.
Later purchases add more credits unless another benefit is expressly shown before purchase.
If a purchase is refunded, credits associated with the refunded amount may be removed. If the purchase that unlocked Premium is fully refunded, the Premium status associated with that purchase may also be removed, without limiting mandatory consumer rights.
6. Artificial intelligence
Vocabulary generation and character chats may use AI systems. AI characters are automated systems and not real people, even when they have a name, avatar, personality or conversational style.
Generated responses may be incorrect, incomplete or unsuitable for a particular situation. Review information before using it for important decisions.
The platform is educational and does not provide professional legal, medical, financial or other specialist advice.
7. User content
You retain any rights you hold in content you submit. You authorise us to process it as needed to provide the requested feature, including sending it to technology providers where necessary.
Do not submit content unless you have the right to use it or where its processing would violate law or third-party rights.
8. Prohibited use
- Do not use the service for unlawful, fraudulent or abusive purposes.
- Do not attempt to bypass technical, security, payment or usage limits.
- Do not access systems, accounts or data without authorisation.
- Do not conduct large-scale automated extraction, reverse engineering or unauthorised exploitation of the service.
- Do not use the service to infringe intellectual-property, privacy or other third-party rights.
9. Withdrawal rights and digital content
If you purchase remotely as a consumer, you may have a statutory right of withdrawal for the applicable period unless a legal exception applies.
Where access to credits, services or digital content begins before that period ends, the checkout must collect any express statements or consents required by law. These Terms do not replace those confirmations.
10. Refunds, prices and taxes
Commercial refund policy: Refunds are handled through Paddle in accordance with its refund policy and applicable law. Purchases may become non-refundable once credits or digital benefits have started to be used where the relevant legal requirements have been met. This does not limit mandatory consumer rights or refunds that may apply in cases such as technical errors, duplicate charges or other applicable circumstances..
The commercial policy does not limit mandatory consumer rights.
Before a purchase is confirmed, the applicable total price and, where relevant, taxes and additional charges will be displayed.
For billing questions, contact jacklyt.code@gmail.com.
11. Suspension and account closure
You may stop using the service and request account closure through the available mechanisms.
We may suspend or restrict an account where reasonably necessary for security, fraud, serious or repeated breaches, legal obligations or risks to other users.
12. Intellectual property and availability
The platform, its code, design, brand, visual elements and proprietary content are protected by the rights held by their respective owners.
We may perform maintenance, updates or changes needed to maintain the security and operation of the service.
13. Liability, privacy and cookies
Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.
Personal-data processing is governed by the Privacy Policy, and cookies, localStorage and similar technologies are explained in the Cookie Policy.
14. Changes, applicable law and contact
We may update these Terms due to legal, technical or service changes. Where required by law, relevant changes will be notified.
The relationship is governed by Swiss law to the extent permitted by applicable law. If you are a consumer, you retain the protection of mandatory rules and jurisdiction rights granted by the law of your place of residence.
